Thanks for using our products and services (“Services”). The products and “Services” are provided by aRacer SpeedTek Inc. (“aRacer”).
By using our Services, you are agreeing to these terms. Please read them carefully.
1. Terms
By accessing the website at https://www.aracer-speedtek.com/, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing aRacer’s service. The service (materials) contained in this contract are protected by applicable copyright and trademark law.
2. Use License
- Permission is granted to temporarily download one copy of the materials (APP or software or information) on aRacer website or aRacer APP on Apple Store / Google Play for personal, defined commercial (as following items) only. This is the grant of a license, not a transfer of title, and under this license you may not:
- modify or copy or break the materials;
- use the materials and modify it for commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained of aRacer;
- remove any copyright or other proprietary notations from the materials;
- This license shall automatically terminate if you violate any of these restrictions and may be terminated by aRacer at any time. Upon terminating your using of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
3. Disclaimer
- The materials of aRacer are provided on an ‘as the design is’ basis. aRacer makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
- Further, in no event shall aRacer be liable for any damages arising out of the use or inability to use the products on aRacer’s website or aRracer APP including all products on aRacer.
- All ECU tunes or flashes from aRacer are for off-road/track use only. None of our products can be used at any time on any emissions control vehicle that is used for anything other than off-road/track performance and shall not be used on public roads.
- Improving the performance of an engine by altering the engine’s ECU software may cause excessive “wear and tear” to the engine and could result in damage or even destruction of the vehicle and injuries. The user assumes these risks. aRacer is not responsible for damage to a vehicle of this kind.
- All products of aRacer have not been tested or approved by any local governing agency and are not approved or recommended for street use. Understanding the legal requirements or legal limitations regarding the use of this product is the sole responsibility of the user.
- All aRacer ECU or software are intended for racing/closed course competition use only. User is responsible for obeying all traffic and governing laws pertaining to their countries of residence. Please tune and drive responsibly.
- For the tuning and any other flashing procedures, the user is responsible for successfully flashing or modifying contents of the engine and is responsible for ensuring the vehicle is in a healthy state for the tuning or flashing procedure. aRacer is not liable for any damages to your ECU / vehicle and offer no warranty.
- Flash / burn software or Installing ECU on the incorrect version will damage or brick your ECU/ Vehicle.
- Unless otherwise specified, the software downloads, the software functions upgraded and purchases from aRacer are digital goods that are not returnable or refundable after purchase. Due to the nature of software functions are turned on, refunds are not possible.
4. Limitations
In no event shall aRacer or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on aRacer website or APP.
5. Accuracy of materials
The materials appearing on aRacer’s website could include technical, typographical, or photographic errors. aRacer does not warrant that any of the materials on its website are accurate, complete or current. aRacer may make changes to the materials contained on its website at any time without notice. However aRacer does not make any commitment to update the materials.
7. Modifications
aRacer may revise these terms of service at any time without notice. By using this service & software functions you are agreeing to be bound by the then current version of these terms of service.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Hsinchu City Taiwan and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
